New York (July 27, 2009): D*sh Network LLC has failed to put an immediate stop to Sonicview USA’s alleged pirating of satellite television programming, as a federal judge has refused to grant a temporary restraining order without first notifying the defendants of the allegations.
On Thursday, Judge M. James Lorenz of the U.S. District Court for the Southern District of California said the plaintiffs had established the probability of prevailing on claims that Sonicview violates D*sh Network’s copyright protections, but he decided against issuing an ex parte TRO and seizure order as it would effectively shutter the defendants’ business.
Plaintiffs D*sh Network, Ech*Star Technologies LLC and N*graStar LLC sought a TRO when they filed suit July 17, without serving Sonicview with the complaint, claiming the defendants sell devices and technology used to illegally decrypt D*sh Network programming.
Judge Lorenz acknowledged the merit of the plaintiffs’ claims under the Digital Millennium Copyright Act, the Communications Act and the Electronic Communications Privacy Act but came short of issuing the ex parte TRO, deeming the seizure order too severe a remedy for the circumstances.
While the defendants may indeed be heavily involved in the manufacture of receivers and software used to intercept and steal D*sh Network’s encrypted signal, issuing the TRO without notice to the defendants risks causing excessive hardship, according to the order.
“In essence, plaintiffs seek to close defendants’ business, including the distribution of any equipment that is not used to pirate D*sh Network’s programming. Contrary to plaintiffs’ claim, the proposed injunction would cause defendants hardship,” Judge Lorenz said.
Plaintiffs failed to substantiate claims that the ex parte TRO is appropriate because Sonicview will likely destroy evidence if they are given notice of the litigation, court said, adding that such intervention is only ever rarely justified.
D*sh Networks contended that the balance of hardship recommended granting the TRO because the order would simply require the defendants to comply with federal and California copyright law, according to the order.
Sonicview allegedly sells its pirating technology through a storefront as well as numerous Web sites.
Dish Network conducted an undercover investigation that confirmed the defendant is developing a device capable of hacking D*sh Network’s latest security system, according to the complaint.
D*sh Network satellite system provides satellite television programming to over 13 million subscribers in the U.S., and the defendant specializes in providing technology that enables consumers to illegally access the programming, the complaint says.
Representatives for D*sh Network could not be reached for comment Monday.
Plaintiffs are represented by Hagan Noll & Boyle LLC.
Counsel information for defendants was not available Monday.

To me that's not really a "hack" but an elaborate card sharing technique. To the press and legal beagles it is a "hack".

unless the pipe smoker gets his landline telephone calls tapped and tells someone (confidential informant) what he intends to do with or how (in detail) he intends to use his pipe illegally....some guys just get diarhea of the mouth and can't help themselves.....

I'd hafta say when sonicview released the ihub add on piece to use it for iks I was rather abit suprised because at one point in time sonicview had explained they would never go iks but now look at them. For you people that are using a iks please make sure you are cautious an very careful.

That kind of thing is very rare and its unlikely that dish lawyers actually expected any result other than what they got. Exparte is usually reserved for emergency life threatening situations such as a stalker who is threatening somebody.

The problem that sonicview , viewsat and others face more than anything is that the source code to their boxes is closed. The architecture is also closed. That means that nobody except someone on the inside with that information can make a new bin. So any box manufacturer that dish takes to court will have a tough time proving that they didn't write the enhanced bins themselves as opposed to "3rd parties" that they all claim. Remember that in a civil case, all dish has to do is show that its "likely" that sonicview and viewsat employed the coders that wrote the bins.

Great post! I agree with every word. Unfortunately, cardbanger sites are rejoicing the fact that the FTA dealers are facing difficult times with DN legal team....not realizing that every victory that DN achieves further diminishes the line between what we do as a hobby and what is deemed illegal and thus grounds for civil/criminal lawsuits. They are not seeing the big picture---every loss that DN accumulates in the court makes it more and more difficult for them to maintain legal grounds for the lawsuits. Cardbangers should be supporting the cause of FTA because their victory is better for all testers!

midal 07-29-2009, 05:05 PM This is wonderful news for the industry.The decision brought down by the courts clearly proves that there is not a political will to stop pirating,if there were the decision by the judge could have turned out differently.Having said this the legal system save the firm that is retained by D**** has very little interest in this industry.Well except perhaps those that own them.Charlies lawyers don,t like FTA but then again who knows they probably have free sat from Dish.The point is this is not glamorus or sexy enough and,unless he goes after the end users is certainly not very profitable.Look for the man who can't except the fact he doesn't own the world just whats outside its boundaries, to be advised to work on better security and stop tying up the courts valuable resources.I am sure that the taxpayers who are on the hook for this legal stuff,don't want to protect his personal interest.We have some seriuos issues we need to tend to in this world and his bottom line isn't one of them.In closing I have very little to write but i feel confident this is a fairly accurate post.I have alot of respect for the knowledge of the Mods and this is a wonderful place to learn.:thmbup:

So you said "chip is easy to hak" is it done or you have done it?? then why its not out there....I easy to talk and don't get me wrong but some developer doing a hard work to crack this.

As far as me doing this... No I was more into hacking mainframes years ago... When I was a young adult... As in Vax's Primes Dec pdp 11/70's Ibm 3090's Ncr 1432's running unix.. Primos, cpl, vms, unix, vm... As far as Phone systems Kosmos Switching stations along with ess 4's Crossbar 5's crossbar 4's and yes i read the bell tech journals when i was a kid in a library... Nice of bell to put them there taught me all about ccit signaling... Yes i am you could say... um Adept.... So yeah I think i just might have somewhat of an idea of what this is all about..... Being it is actually machine code... which is usually run by a processor.. Its um algorithmic I do believe, correct me if i am wrong... So um yes i think I have some knowledge.. I am sure not as much as you but you know I try.....

Its tragic news for SV and FTA. The Judge has ruled in favor of DN stating YES SV is doing what its doing. Now I want you (DN) to wait a day and notify SV you are going to seize everything then come back here and we will do it. The Judge just told SV in so many words, see you boys real soon. Some of you may think this is good news, but again some of you only read what you want to read. "Not good at all" SV will be sued and very soon.

Some of you may think this is good news, but again some of you only read what you want to read. "Not good at all" SV will be sued and very soon.
So you decided to join recently to tell us what is good and bad? seems it's bad for you but you got to see the whole picture from start. They are already been sued what is new in that? we expect it coming, for other providers too if you don't know. DK is doing very harsh moves to stop or prevent anything that they neglect in past. They are trying to manage and control the market. If SV could have time as stated from the document then they could regroup. It's all a game, with a high risk.

I'd hafta say when sonicview released the ihub add on piece to use it for iks I was rather abit suprised because at one point in time sonicview had explained they would never go iks but now look at them. For you people that are using a iks please make sure you are cautious an very careful.
true but stopping the manufacturing or distribution of internet equiped FTA receivers & dongles will not be an easy task for dishnet, simply stating that illeagal tv reception is the only purpose for these devices is BS, if manufacturers do it right & release factory software to allow users to connect to a game server or stream media to or from the fta box to their PC over their home network the device then has a viable leagal purpose, what right does one company have to put another out of business just because someone has found a way to use the device for illegal purposes, I do not see the courts stopping the production of guns because 90% of them are used to commit crimes or shoot people, no the other 10% witch are used for hunting & self defense ensure that a nice flow of hardware is readily available if you decide to rob the local mini mart or shoot the guy next door because his dog keeps pooping on your lawn, oh my god what has this world come to! :evil: LOL

1. is this guy quaified asan expert? he is just qualifed as mickey mouse is.
2. damages? dish network has to prove they have suffered financial damages. with COOLSAT taking the 106 millidollar hit, any lawyer is going to say that dish network has never spent 106 towards piracy, so they are still alot of money ahead. Now that you have no damages... how can you get a judgemnet for money? coolsat is the hero,,,,, they took the hit to keep fta alive,,,,,,oh there is a plan,,, bamkruptcy? maybe a new system? maybe stocks in dish network? LOL,,
anyways,
dish is going to have a lot of problems now, thanks to coolsat...........
