i don't understand why ur worried. viewsat is countersuing dish and echo star. apartently echostar also offers fta box's in europe and like all the others, bin files are realsed for echostar stb's. so now with that said, viewsat is claiming that echostar is attempting to corner the market and also monopolize the fta ranks. i have the court filed doc's to show that. i am sure sonicview is also aware of the same info.

The Report in the PDF is very bias. Anyone that has worked with Asian electronics knows without a brand (or in some cases even with a brand) electronics is cloned, copied and duplicated to a degree that makes it difficult to tell who makes something.

I would challenge the writer of the report to enable IKS, Ihub or anyother "factory" feature and obtain Dish Network programming, It is just not possible. You must use "3rd Party" software"

Any good lawyer will have a field day, picking the worthless, bias report apart. It just wouldn't be that hard. Scare tactic, that failed maybe.

I don't always have the time to check into the fta scene and this is new news to me. Thank you for sharing.

any capable lawyer can easily dismantle the proponents argmemts, for being selfserving and overly vague.

Freetech did the same exact thing. They counter sued ech***** the exact same way claiming that it was anti competitive. It was solidly struck down in court already. So I doubt that the countersuit will get very far since there now is case law that can be refered to in the Freetech case. We all know what happened to Freetech and Coolsat.

Freetech did not lose their lawsuit ! What they did was agree to stop selling FTA units and components and turn over all sales records to DN!!!! They don't have to pay DN anything unless they breach this agreement!! Anyway, I've strayed from the original post, so I'll say no more!!:sleep:

Ok Fine..... They lost by agreement... Look nothing against you but I read the entire case against Freetech. They lost. Threw in the towel because the evidence was stacked against them. So If in your eyes this is not a lost case... So be it. It sure looks like a lost case to me. So like I said, Freetech counterfiled along the same lines claiming a monopoly would be in Echo***** favor if they continue to use the courts to eliminate the competition. They then conceeded.... Go read the order again jadamk. Then try to explain how they won? You were right about some of the fines not being levied... that was before this part of the judgement. That part you refer to says....
3 CONSENT FINAL JUDGMENT AND
PERMANENT INJUNCTION
(b) assembling, modifying, selling, importing and/or distributing any satellite television receivers, set-top-boxes, software, firmware, or other device, technology or part thereof knowing or having reason to know that such device, technology or part thereof is primarily of assistance in the unauthorized decryption of direct-to-home satellite services through any means including any Internet Key Sharing (also known as Control Word Sharing);
(c) intercepting Plaintiffs’ transmissions without Plaintiffs’ authorization through any means including Internet Key Sharing (also known as Control Word Sharing);
(d) assisting others in intercepting Plaintiffs’ satellite television transmissions without Plaintiffs’ authorization through any means including Internet Key Sharing (also known as Control Word Sharing); and
(e) Testing, analyzing, reverse engineering, manipulating or otherwise extracting codes or other technological information or data from Plaintiffs’ satellite television receivers, access cards, data stream or any other part or component of Plaintiffs’ security system or other technology used to gain access to DISH Network programming including through the use of Internet Key Sharing (also known as Control Word Sharing).
(2) This Permanent Injunction takes effect immediately.
(3) Should a Defendant(s) breach any part of this Final Judgment or permanent injunction, the breaching Defendant(s) shall be subject to damages in the amount of $110,000 for each such breach or violation, which is the maximum statutory damage permitted per violation under 47 U.S.C. § 605(e)(3)(C)(i)-(ii).
